Analytical Testing License
As of October 2018, the Cannabis Act will require that facilities possess an Analytical Testing License in order to legally test and assess the quality of cannabis products that are otherwise prepared for distribution.
To confirm the purity and potency of all medicinal and recreational cannabis allotted for sale, the products must be put through an extremely rigorous chemical and microbiological testing process. Facilities with an Analytical Testing License will be able to work closely with other licensed cannabis operations in need of these services, such as companies that focus on cultivation and processing. Those who obtain this license can legally hold and alter small amounts of cannabis and cannabis derivatives. Due to the low quantity of product that facilities are allowed to have on-site at any given time, necessary security measures are lighter than those required for, say, a Cultivation License. Ultimately, the Head of Laboratory is responsible for ensuring that the analyses they oversee are entirely faultless.
Cultivation License Solution
Under the new Cannabis Act & Regulations, there are three types of licenses for cannabis cultivators to consider: the Standard Cultivation License, Micro-Cultivation and Nursery Licenses. While these licenses allow facilities to cultivate plants, a Nursery License provides for the cultivation of cannabis genetics.
As of October 17th, 2018, the indoor and outdoor cultivation of medical and recreational cannabis will be legal in Canada. A Standard or Micro Cultivation license allows for the holder to grow cannabis through unspecified means under the Act, including but not limited to using aeroponics, hydroponics, aquaponics, vertical planters, and in traditional soil. In order to decide which license class is a business’ best fit may, in part, be determined by a facility’s canopy size. Those with canopies equal or less than 200 square meters in size (this includes multiple and vertically arranged surfaces) fit the description of Micro Cultivators, with anything larger qualifying for the Standard Cultivation License – a great option for big and growing companies. Alternately, enterprises interested in the development of starter plant material and new plant varieties with goals of altering cannabis genetics to make seeds, seedlings and clones should pursue a Nursery License.
Cannabis can be sold for both recreational and medical purposes under the new Act and Regulations, but not all retail licences are handled federally. The federal government oversees licences for medical cannabis retail, but have given provinces and territories responsibility over recreational distribution and sale. They are in charge of developing, implementing, maintaining, and enforcing plans to handle the sale of non-medical cannabis. Under the Act, they are required to collaborate with municipalities to create their own legislation that consistently protects public health and safety.
